FACTS:
Jacinto de los Santos, Feliciano Quiambao, and Gabriel Garcia, along with three others, were charged with the crime of robo en cuadrilla (robbery in an armed band) committed in the house of the offended parties. The trial court found them guilty. Gabriel Garcia was identified as the leader of the band. The crime was marked by the aggravating circumstances of nocturnity and being committed in the house of the offended parties. The trial court sentenced Jacinto de los Santos and Feliciano Quiambao to eight years of presidio mayor each, and Gabriel Garcia to ten years of presidio mayor.
ISSUE:
What is the correct penalty to be imposed upon the accused for the crime of robbery in an armed band, considering Gabriel Garcia was the leader and the presence of aggravating circumstances?
RULING:
The Supreme Court affirmed the conviction of the accused but modified the penalties imposed by the trial court. The Court held that the facts proven constitute the crime of robbery in an armed band with violence and intimidation, aggravated by nocturnity and commission in the dwelling, as defined and penalized in Article 504, read together with paragraph 5 of Article 503 of the Penal Code.
Based on the Penal Code:
For members of the band other than the chief (Jacinto de los Santos and Feliciano Quiambao), the correct penalty is the maximum degree of presidio correccional to presidio mayor in its medium degree, which translates to ten (10) years of presidio mayor.
For the chief of the band (Gabriel Garcia), the penalty is the maximum degree of the immediately superior penalty, which is presidio mayor in its maximum degree to cadena temporal in its medium degree.
Therefore, the Court reversed the trial court’s sentence regarding the penalties and imposed the following:
Jacinto de los Santos and Feliciano Quiambao were each sentenced to ten (10) years of presidio mayor.
Gabriel Garcia was sentenced to fourteen (14) years, eight (8) months, and eleven (11) days, along with the accessory penalties prescribed by Articles 56 and 57 of the Penal Code.
The judgment and sentence of the trial court were affirmed as thus modified.
