GR L 24990; (July, 1968) (Digest)
G.R. No. L-24990 July 3, 1968
WILLIAM C. PFLEIDER, plaintiff-appellee, vs. REPUBLIC OF THE PHILIPPINES (Represented by the Land Authority), ET AL., defendants-appellants, JOSE G. ESPINO, defendant.
FACTS
The parties, after filing their briefs and submitting the case for decision, agreed to a compromise. On June 19, 1968, they submitted a Compromise Agreement to the Supreme Court. The agreement stipulated that: (1) plaintiff-appellee William C. Pfleider waives all his rights under the decision of the Court of First Instance of Negros Occidental in Civil Case No. 206, which decision would become unenforceable upon the Court’s approval of the compromise; (2) in consideration, defendants-appellants (the Republic represented by the Land Authority) likewise waive all their rights and interest in the property subject of the litigation by virtue of the Deed of Absolute Sale sought to be enforced in the action; and (3) the defendants-appellants’ waiver does not prevent the government from later acquiring the property under existing legislation for land reform purposes, specifically for subdivision into economic-size farm units to establish owner-cultivatorship.
ISSUE
Whether the Compromise Agreement submitted by the parties should be approved by the Court.
RULING
The Supreme Court approved the Compromise Agreement and rendered judgment in accordance with its terms. No costs were awarded.
