FACTS
This is an original action for certiorari filed against the Public Service Commission and other parties. The order complained of was issued by the Commission on March 5, 1964, granting provisional permits to operate a total of 1,000 taxicab units in Manila to one hundred twenty-five applicants and oppositor counter-applicants. On September 4, 1964, the respondent Commission rendered a decision granting permanent certificates of public convenience to the respondents, either confirming or increasing the number of units granted under the provisional order of March 5, 1964. Respondent Jose M. Silva subsequently filed a motion to dismiss the certiorari case on the ground that the Commission’s final decision had rendered the action moot. Petitioners interposed no objection to the dismissal of the petition concerning nine specific cases enumerated in their pleading.
ISSUE
Whether the petition for certiorari assailing the provisional order of the Public Service Commission has been rendered moot and academic.
RULING
Yes. The Court dismissed the petition. The order complained of granted mere provisional permits. This provisional order was necessarily superseded by the final decision rendered by the Public Service Commission on September 4, 1964. Consequently, the present case, as a whole, has become academic. The petition was dismissed without costs.
