FACTS:
Carmen Ayala de Roxas (plaintiff-appellee) filed an action to recover possession of a parcel of land in Manila occupied by Juana Valencia (defendant-appellant). During trial, the plaintiff presented documents to establish her title. The defendant, to prove her own claim of possession since 1858 and title derived from a purchase from one German Bate, offered a document into evidence. The lower court refused to admit this document, ruling that it pertained only to the defendant’s right to a house on the land, not to the land itself. The defendant excepted to this ruling.

RULING:
Yes. The Supreme Court held that the lower court erred in excluding the document. The defendant claimed the document was proof of her title to the land, and its exclusion prevented a proper determination of its relevance and weight. Since the document was not included in the bill of exceptions, the Supreme Court could not review its contents to assess the error’s materiality. Consequently, the judgment of the lower court was revoked, and the case was remanded for a new trial to allow the document to be properly admitted and considered.
