Delfin Yambao, plaintiff-appellant, vs. Angelina Gonzales, et al., defendants-appellees.
FACTS
Maria Gonzales executed a will in 1942 bequeathing her properties in Sta. Rosa, Laguna to the defendants-appellees, Angelina Gonzales and Maria Pablo. A specific clause in the will stated that the heirs had a “TUNGKULIN O GANGPANAN” (duty or task) and that they should “Pahihintulutan” (allow) the plaintiff-appellant, Delfin Yambao, to work on the riceland as a tenant for life. The will was probated in 1948.
Following probate, Yambao approached the defendants to request his placement as tenant on the subject land, pursuant to the will’s directive. The defendants refused, having already appointed another tenant. Yambao subsequently filed this action to compel the defendants to employ him as a lifetime tenant and to deliver the value of harvests due to him.
ISSUE
Whether the provision in the will of Maria Gonzales directing the heirs to allow Delfin Yambao to work as a tenant imposes a mandatory legal obligation upon the heirs, or merely a non-binding suggestion or moral duty.
RULING
The Supreme Court reversed the trial court’s dismissal and ruled in favor of the appellant. The trial court erred in interpreting the word “Pahihintulutan” (to allow) in isolation, concluding it was merely permissive and thus only a moral suggestion. The correct legal interpretation requires examining the entire clause.
The directive is prefaced by clear language imposing a “TUNGKULIN O GANGPANAN” (duty or task) upon the heirs. This context transforms the subsequent instruction to “allow” Yambao to work from a mere suggestion into a mandatory obligation the heirs are duty-bound to carry out. The testatrix’s intent was to create a compulsory provision for the benefit of Yambao. The Court distinguished this from a conditional institution of an heir under the invoked Article 797 of the old Civil Code, which was found inapplicable.
Consequently, the provision constitutes a valid testamentary mandate creating a legally enforceable right in favor of Yambao. The defendants-appellees are ordered to employ Delfin Yambao as a tenant on the subject land immediately upon the finality of the decision.
