FACTS
– Ladislao Patriarca, a lessee of a tract of land in San Juan, Cavite, alleged that he mortgaged the land and its “improvements” to Inocencio Olimpo and his wife Juana Orate to secure a ₱323 loan.
– Patriarca later attempted to redeem the property; Olimpo refused.
– The defendants (Juana Orate) contended that: (1) the lease of the land had been transferred to Inocencio Olimpo by the hacienda’s administrator as early as 1860; (2) the “improvements” could not be mortgaged; and (3) Olimpo had purchased the improvements from Patriarca for ₱323, thereby negating any mortgage.
– Evidence was offered only regarding the existence of a lease and possession; the nature, existence, or value of the alleged improvements (buildings, crops, etc.) was never proved.
ISSUE
Whether the plaintiff’s alleged mortgage (or any contract) over the “improvements” is valid and enforceable, and whether a judicial order directing delivery of the land/improvements to the plaintiff is proper given the lack of proof of the improvements and the fact that the land belongs to a third‑party owner.
RULING
The Supreme Court reversed the lower court’s judgment.
– The Court held that the improvements were never adequately identified, and no competent evidence showed they existed or could be the subject of a mortgage, antichresis, or purchase‑with‑redemption.
– Consequently, the plaintiff had no enforceable right to redeem; the alleged contract was neither a mortgage nor an antichresis under the Civil Code, nor a valid sale.
– The order to deliver the land would unlawfully deprive the true owner (the hacienda) and the lessee’s successor of their rights; the action was personal (in personam), not a real action (in rem) against the property.
– Errors concerning the land’s ownership, the nature of the contract, and the jurisdiction of the court were sustained.
The judgment of the Court of First Instance was annulled, no costs were awarded, and the case was remanded for execution of the reversed decision.
