FACTS
An Information was filed against petitioner Marvin L. San Juan charging him with subjecting AAA, a 15-year-old minor, to “psychological cruelty and emotional maltreatment” by threatening his life and poking a gun at him while drunk. The Regional Trial Court convicted San Juan of child abuse under Section 10(a) of Republic Act No. 7610 . The Court of Appeals sustained the conviction but modified the designation of the offense to grave threats in relation to Section 10(a) of Republic Act No. 7610 . The ponencia affirmed the conviction but deleted the correlation to grave threats, convicting him of violation of Section 10(a) in relation to Section 3(b)(1) of Republic Act No. 7610 . Justice Leonen, in his Concurring Opinion, concurs with the result but offers observations on the interplay between Republic Act No. 7610 , Presidential Decree No. 603, and the Revised Penal Code.
ISSUE

RULING
Justice Leonen concurs that petitioner Marvin L. San Juan should be convicted of violating Section 10(a) in relation to Section 3(b)(1) of Republic Act No. 7610 . He agrees with the ponencia’s deletion of the correlation to grave threats. However, he disagrees with the ponencia’s comparative table suggesting that the acts under paragraphs 8 and 9 of Article 59 of Presidential Decree No. 603 are on all fours with specific provisions of the Revised Penal Code. He observes that paragraph 8 (inflicting cruel and unusual punishment causing embarrassment or humiliation) requires an additional element not present in Articles 263, 265, 266, and 358 of the Revised Penal Code (serious physical injuries, less serious physical injuries, slight physical injuries and maltreatment, and slander). Similarly, paragraph 9 (causing or encouraging a child to lead an immoral or dissolute life) is broader and not limited to the prostitution of children penalized under Article 340 of the Revised Penal Code. He emphasizes that Republic Act No. 7610 is a special law designed to protect children from all forms of abuse and that psychological abuse, as defined in Section 3(b)(1), includes acts causing emotional harm, such as the gun-poking incident in this case, which subjects the child to unnecessary mental suffering and disturbs his emotional well-being.
