FACTS:
The defendant, Juan Angel Michelena, applied for a civil service examination. As part of his application, he submitted a printed form prescribed by the Civil Service Board. This form contained a “certificate of merit” (Certificate No. 3) purportedly recommending him, which was subscribed in the name of one Frank N. West. However, it was established that Frank N. West neither signed this certificate nor wrote its contents. Furthermore, the information contained in the certificate regarding the certifier’s age and the length of time he had known the applicant was incorrect. The defendant, despite having received his admission ticket, did not appear for the scheduled examination. Consequently, the falsified document was never officially filed or made part of any public record.
ISSUE:
What crime was committed by the defendantconsummated falsification of a public document under Articles 300 and 301 of the Penal Code, or falsification of a private document under Article 311?
RULING:
The Supreme Court ruled that the defendant committed the crime of falsification of a private document under Article 311 of the Penal Code, not consummated falsification of a public document.
The Court reasoned that for a document to be considered a public document, it must be executed with the required formalities and become part of an official record. In this case, since the defendant did not take the examination, the falsified certificate of merit was never submitted to or recorded by the Civil Service Board. Therefore, it never attained the status of a public document. The act was properly classified as the falsification of a private documentspecifically, a certificate of merit.
The penalty for this crime under Article 311 is arresto mayor in its medium degree. Accordingly, the Court modified the lower court’s sentence and sentenced Juan Angel Michelena to two months and one day of arresto mayor, with credit for one-half of the preventive imprisonment he had already undergone.
