FACTS
The prosecution’s evidence established that on December 28, 1996, in Butuan City, appellant Danilo Andrade raped the 13-year-old complainant, AAA. While AAA was walking home, Andrade dragged her into the bushes, covered her mouth, pointed a bolo at her, and forcibly had carnal knowledge of her despite her struggles and pleas. He then threatened to kill her if she reported the incident. AAA immediately informed her mother. A medical examination revealed physical findings consistent with sexual intercourse. The defense presented a denial and alleged that AAA’s mother, Nena Morales, was his paramour and had fabricated the charge after he ended their relationship. The trial court convicted Andrade of rape and sentenced him to reclusion perpetua.
ISSUE
The core issue is whether the prosecution proved the crime of rape beyond reasonable doubt, particularly overcoming the defense of denial and alibi and addressing the alleged inconsistencies in the victim’s testimony.
RULING
The Supreme Court affirmed the conviction. The Court emphasized that in rape cases, the credibility of the victim’s testimony is paramount. AAAβs categorical, consistent, and straightforward narration of the forcible sexual assault, corroborated by her immediate report to her mother and the medical findings, constituted proof beyond reasonable doubt. The Court found her testimony credible and natural, detailing her resistance and the pain she endured. The defense of denial and alibi, unsupported by clear and convincing evidence, cannot prevail over the positive identification by the victim. The alleged delay in reporting to barangay authorities was sufficiently explained by the initial fear instilled by the appellant’s death threat and the attempt at a private settlement, which does not undermine the truth of the charge. The Court upheld the trial court’s assessment of witness credibility, finding no reason to overturn its factual conclusions. The award of civil indemnity and moral damages was likewise sustained.
