FACTS
The appellants, along with an accused-at-large, were charged with the murder of Robert Pagayon. The prosecution alleged that on November 20, 1996, in Passi, Iloilo, the accused conspired to attack and assault the victim with fists, kicks, and bamboo poles, resulting in his death from multiple physical injuries. Eyewitness Michael Pagayon testified that he saw the appellants beating an unidentified man near a river. The victim’s mother, Marina Pagayon, stated that appellants took her son to work on a well and later presented his clean, lifeless body, claiming he died from a fall. The family’s suspicions were aroused by the clean body, changed clothing, and appellants’ instructions to avoid an autopsy and to conceal the death.
ISSUE
Whether the guilt of the appellants for the crime of murder was proven beyond reasonable doubt.
RULING
No. The Supreme Court reversed the conviction and acquitted the appellants. The prosecution failed to prove the corpus delicti—the fact that a crime was committed—beyond reasonable doubt. The evidence did not conclusively establish that the victim’s death resulted from a criminal agency. The testimony of eyewitness Michael Pagayon was deemed insufficient as he could not positively identify the victim of the beating he allegedly witnessed as Robert Pagayon. His claim of recognition two weeks later via a radio report was unreliable hearsay. The circumstantial evidence, including the appellants’ suspicious behavior after the death, was inadequate to form an unbroken chain leading to the sole conclusion of guilt. The Court emphasized that while the circumstances raised grave suspicion, suspicion alone is not a substitute for proof. The constitutional presumption of innocence must prevail when the evidence does not meet the required quantum of proof. Consequently, the appellants were ordered released unless detained for other lawful causes.
