FACTS
The prosecution established that in the early morning of January 8, 1999, in Makati City, accused-appellant Rogelio Moreno y Reg, armed with a fan knife, accosted the victim, Marites Felix, as she walked home from work. He dragged her to a vacant space, pointed the knife at her throat, and forcibly removed her clothing. Despite her pleas, he threatened to kill her if she made noise and proceeded to have carnal knowledge of her. After the sexual act, he snatched her shoulder bag containing cash and personal items, including her work T-shirt, and fled. Marites reported the incident, and with police assistance, they located Rogelio hiding in a compound. She immediately and hysterically identified him as her assailant. Notably, he was found wearing her missing Burger Machine T-shirt, which bore identifiable stains. Medico-legal examination confirmed recent sexual intercourse.
The defense presented a different account, claiming Rogelio and Marites were lovers and that their sexual encounter was consensual. He alleged he was framed after a quarrel and that the T-shirt was given to him by Marites. The trial court rejected this defense, finding the prosecution’s evidence credible and convicting Rogelio of the special complex crime of robbery with rape, imposing the death penalty.
ISSUE
Whether the trial court correctly convicted accused-appellant of the special complex crime of robbery with rape.
RULING
No. The Supreme Court affirmed the conviction but modified the nature of the crimes and the penalties. The Court held that the special complex crime of robbery with rape under Article 294(2) of the Revised Penal Code requires that the robbery itself be the main purpose, and the rape is committed on the occasion thereof or as an accompanying crime. Here, the evidence showed that the taking of the victim’s property was merely an afterthought. Rogelio explicitly told the victim, “I do not need money,” when she offered her bag during the assault, and he only snatched her bag after the rape had been completed as he fled the scene. Consequently, the elements of the special complex crime were not met. The rape and the theft (the unlawful taking of personal property with intent to gain) were separate and distinct crimes. The rape was proven beyond reasonable doubt through the victim’s credible and categorical testimony, corroborated by medical findings and her spontaneous identification of the appellant found wearing her stolen shirt. The penalty for the rape is reclusion perpetua, as the death penalty could not be imposed due to the failure to prove the qualifying circumstance of the robbery. The theft of the bag and its contents, valued at ₱200, warranted the penalty of six months of arresto mayor. The award of damages was also modified accordingly.
