GR 132991; (October, 1999) (Digest)
G.R. No. 132991 . October 4, 1999.
COL. RODOLFO MUNZON, in his capacity as Chief Security Department Ninoy Aquino International Airport; NESTOR JIMENEZ, as Airport Policeman, and JOSE NERI ROA, petitioners, vs. INSURANCE SAVINGS AND INVESTMENT AGENCY, INC., respondent.
FACTS
The case originated from a complaint for Forcible Entry filed by Insurance Savings and Investment Agency, Inc. (ISIA, Inc.) against Jose Neri Roa and others before the Metropolitan Trial Court (MeTC) of Pasay City. The MeTC dismissed the complaint. ISIA, Inc. appealed to the Regional Trial Court (RTC) of Pasay City, Branch 110, which reversed the MeTC’s decision, declared the intrusion into ISIA’s premises illegal, and ordered the restoration of possession to ISIA. Petitioners appealed to the Court of Appeals, which affirmed the RTC decision. Petitioners then filed a Petition for Review on Certiorari before the Supreme Court. While the case was pending before the Supreme Court, the parties filed a Joint Motion for Judgment based on a Compromise Agreement dated July 8, 1999, entered into between ISIA, Inc. and Jose Mari C. Roa. The agreement stipulated that Roa would pay ISIA, Inc. the sum of Two Hundred Thousand Pesos (P200,000.00) as full settlement of all claims in the forcible entry case, and in consideration, ISIA, Inc. would waive its legal rights against Roa and the other defendants and respect Roa’s peaceful possession of the subject premises through Air Ads, Inc.
ISSUE
Whether the Compromise Agreement entered into by the parties should be approved by the Court.
RULING
The Supreme Court approved the Compromise Agreement. The Court found the agreement to be in order and not contrary to law, public morals, or public policy. Consequently, judgment was rendered in accordance with the terms of the Compromise Agreement. The parties were enjoined to comply strictly and in good faith with its terms. In view of the compromise, the issues in the case had become academic. Therefore, the case was dismissed with prejudice.
