FACTS
The prosecution’s evidence established that on July 21, 1993, in Cebu City, 17-year-old Joceline Yosores was in her boarding house room. Appellant Andrew Pacina, the nephew of the house owner, entered, locked the door, and turned up the volume of the television and radio. He then forcibly pinned Joceline down on a bed, covered her mouth when she shouted, and proceeded to have carnal knowledge with her against her will. Joceline struggled but was overpowered, lost consciousness, and later awoke to find herself bleeding profusely. She was eventually hospitalized for a week due to a vulvar hematoma requiring an operation. The defense presented a “sweetheart theory,” claiming the sexual act was consensual.
ISSUE
The core issue is whether the prosecution proved the crime of rape beyond reasonable doubt, particularly overcoming the defense of consensual relations.
RULING
The Supreme Court affirmed the conviction. The Court upheld the trial court’s assessment of witness credibility, emphasizing that the firsthand observation of a witness’s demeanor is a compelling basis for conviction, which appellate courts generally do not disturb. The medical findings, specifically the vulvar hematoma necessitating surgery, provided strong physical corroboration of the complainant’s testimony of a violent assault, directly contradicting the claim of consensual sex. The defense of a romantic relationship was deemed inherently weak and insufficient to overturn the clear, credible, and consistent narrative of force and intimidation.
