The Deserters’ Pact and the Birth of the State in GR 1480

The case United States v. Francisco de la Cruz et al. (1904) is not a mere administrative adjudication of banditry; it is a primal scene of political foundation. Here, the new sovereign-the United States colonial government-confronts the specter of its own creation: soldiers who deserted, taking their arms, to form an armed band. This is the state’s nightmare-the lawful instrument of violence turning against the legal order, becoming a competing source of authority in the mountains. The court’s dry recitation of facts-desertion, armed demands for rice and money, sequestration of policemen-masks a profound drama: the struggle to assert the monopoly of legitimate force. The band under Dalmacio Caambol, appointed by a rebel general, represents a counter-sovereignty, a rival mythos of power and provision. The trial is thus a ritual of reclamation, where the state must symbolically reabsorb these wayward limbs of its own body politic, declaring their violence illegitimate and its own alone lawful.

The narrative transcends the particularity of 1903 Rizal; it echoes the eternal confrontation between nomos (law) and physis (wild force). The defendants moved from the disciplined, uniformed space of the “volunteers”-a provisional incorporation into the sovereign project-back into the amorphous, mountainous band. This geographical and moral shift is mythic: from the city of law to the forest of outlawry. Their crimes are not mere thefts but symbolic usurpations: they “demand” rice and money as a pseudo-tax, and seize policemen-the very agents of local order-dragging them into the wild. In doing so, they mimic the state’s functions while subverting its essence, revealing that sovereignty is, at its core, a performance of control over resources and bodies. Thus, GR 1480 is a foundational text of political theology. The guilty verdict is a performative utterance: it draws the boundary between legitimate and illegitimate violence, between a “soldier” and a “brigand.” The colonial state, still in its fragile infancy, uses this case to narrate itself into being by defining its opposite. The profound universal truth here is that law is born not from consensus alone, but from the successful designation and suppression of its doppelgänger-the band that mirrors the state’s structure yet operates outside its covenant. The case is a creation myth: order declaring chaos unlawful, and in that very act, constituting its own authority.
