FACTS:
On the evening of February 27, 1902, a quarrel occurred at the Junquera Theater in Cebu between Vicente Sotto and Fidel Alberto Moas. The Spanish Consul, present at the theater, went to the vestibule during the disturbance. According to the Consul’s testimony, he was attacked and knocked to the ground by municipal policemen. Seventeen policemen were charged. During trial, the prosecution struggled to present witnesses who could identify the specific assailants. The trial court, after a series of dismissals of charges against various defendants to make them state witnesses, ultimately convicted defendants Feliciano Lucinario, Marcelino Rama, Tomas Naval, and Estanislao Tirado of violating Article 419 of the Penal Code (inflicting less grave injuries upon a person holding public rank or authority) and sentenced each to prision correccional. They appealed.
ISSUE:
Whether the evidence presented was sufficient to sustain the conviction of the appellants for the crime charged.
RULING:
The Supreme Court PARTIALLY GRANTED the appeal.
1. As to the Government’s Appeal: It was dismissed based on Kepner v. United States (prohibiting double jeopardy).
2. As to Defendants Lucinario, Rama, and Tirado: The evidence was INSUFFICIENT to prove their guilt beyond reasonable doubt. No witness positively identified them as participants in the assault on the Consul. The testimony against them was either speculative, based on height rather than facial recognition (Tirado), or contradicted by other evidence placing them elsewhere. Their convictions were REVERSED and they were ACQUITTED.
3. As to Defendant Naval: The evidence was SUFFICIENT. Naval admitted, both in writing and at trial, that he struck the Consul. His defense that he was provoked by being struck first by the Consul’s cane was not substantiated by the evidence. His conviction was AFFIRMED.
4. On the Crime Committed: The Court held that the Spanish Consul qualified as a “dignidad” (dignitary) under Article 419 of the Penal Code, not as a “public authority.” Therefore, the crime was correctly classified as inflicting less grave injuries upon a dignitary.
DISPOSITION:
The judgment of the trial court was reversed as to Feliciano Lucinario, Marcelino Rama, and Estanislao Tirado, who were acquitted. The judgment was affirmed as to Tomas Naval, who was convicted under Article 419 of the Penal Code and sentenced to one year, eight months, and twenty-one days of prision correccional.
