FACTS:
The defendant, Vicente Garcia Valdez, was charged with libel as the editor of a weekly newspaper that published allegedly defamatory material in its issue dated August 25, 1901. To prove that Valdez was the editor, the prosecution presented copies of a later issue of the same newspaper dated October 6, 1901, which referred to him as the director. No other evidence was presented to link Valdez to the publication of the libelous article in the August 25 issue. The trial court acquitted Valdez due to insufficient evidence. The private prosecutor, Jovito Yusay, appealed the acquittal to the Supreme Court.

RULING:
No. The Supreme Court affirmed the trial court’s judgment of acquittal. The Court held that the October 6, 1901 issue, standing alone, was insufficient to prove that Valdez was the director of the newspaper on August 25, 1901. Even assuming the October 6 issue established his role at that later date, it did not provide evidence of his involvement or position at the time the alleged libel was published. Without additional evidence connecting Valdez to the August 25 issue, the prosecution failed to meet its burden of proof. The acquittal was upheld, with costs imposed on the appellant.
