FACTS:
On the night of July 27, 1907, appellant Francisco Sobrejuanete, along with two co-accused and four unknown persons, all armed, attacked the storehouse of Jacinto Guilaran. They forcibly took P700 in currency and P500 worth of goods, totaling P1,200. The robbery was committed at night, and advantage was taken of the darkness. The trial court convicted all the accused of robbery in an armed band, sentencing each to six years and one day of presidio mayor, to pay P200 to Guilaran for civil damages due to mistreatment (with subsidiary imprisonment in case of insolvency), and costs. Sobrejuanete appealed, questioning his identification, but the Supreme Court found his guilt conclusively established by the evidence.
ISSUE:
Whether the trial court correctly imposed the penalty and civil liabilities for the crime of robbery in an armed band.
RULING:
The Supreme Court reversed the judgment and sentence of the trial court regarding the penalty and civil liabilities, while affirming the finding of guilt.
The Court held that the trial court erred because:
1. The penalty for robbery in an armed band (defined and penalized in paragraph 5 of article 503 of the Penal Code) should have been imposed in its maximum degree due to the aggravating circumstance that advantage was taken of the darkness of the night. The correct maximum penalty is ten years of presidio mayor.
2. The trial court failed to provide for the return of the stolen property or payment of its proven value (P1,200) to the owner.
3. The trial court erred in allowing subsidiary imprisonment in case of insolvency for the civil indemnity, which is in violation of paragraph 1, article 50 of the Penal Code.
Accordingly, the Supreme Court found Francisco Sobrejuanete guilty of the crime of robbery in an armed band, committed at night, and sentenced him to:
Ten years of presidio mayor.
P100 damages to Jacinto Guilaran for mistreatment received (reduced from P200).
Restore the stolen property or pay its proven value of P1,200 to the owner, but without subsidiary imprisonment in case of insolvency.
Pay one-third of the costs in the first instance and all costs of the appeal.
