FACTS

This case involves the partition of Lot No. 4844 (formerly Lot No. 217-A) among the claimants. The judicial partitioning commissioner submitted two alternative subdivision plans. The first plan would give each party two separate lots but would include a camarin (shed) housing Antonio Ramos’s distillery in his portion. The second plan would give each party a single, contiguous lot, but the camarin would be located on Pedro Loyola’s allotted portion. The commissioner recommended the second plan, reasoning that while both plans equitably divided the land and improvements, the first plan would diminish the value of each share by breaking the land into two separate lots for each party. The lower court adopted the second recommended plan. Antonio Ramos appealed, arguing that this partition was unequal and unjust.

ISSUE

Which of the two proposed subdivision plans should be adopted in the partition of the lot?

RULING

The Supreme Court AFFIRMED the decision of the lower court, upholding the adoption of the second subdivision plan. The Court held that in the exercise of judicial discretion to settle the parties’ disagreement, the court must consider the interests of all concerned and adopt the form of partition that is most equitable, reasonable, and just. The second plan was more favorable to both parties as it avoided breaking up the land, which would cause depreciation in its value. The Court also noted that the distillery in the camarin was not owned by any of the parties to the partition (the minor claimants) and was no longer in use, with only a worthless shed and an unused oven remaining. Therefore, the distillery’s location should not influence the choice of partition, as it does not belong to the landowners and would have to be removed regardless of the plan adopted.
