FACTS:
The case was appealed to the Supreme Court. The defendant-appellant filed a motion seeking a stay of execution of the judgment rendered by the trial court pending the resolution of the appeal. The trial court had previously denied a similar motion for stay of execution.
ISSUE:
Whether the Supreme Court should grant the defendant-appellant’s motion for a stay of execution of the judgment pending appeal.
RULING:
The Supreme Court DENIED the motion for stay of execution. The Court held that there was no change in the status of the parties or the subject matter of the case that would justify modifying or annulling the trial court’s earlier ruling denying the same motion. The decision of the trial court was therefore left undisturbed.
