Joy Batislaon Balicbalic, Petitioner, v. People of the Philippines, Respondent.
FACTS
Petitioner Joy Batislaon Balicbalic worked as a cashier at SM Hypermarket in Pasig City. On November 14, 2005, Security Guard Ryan Pacheco observed that Joy did not scan some grocery items purchased by her aunt, Lourdes Gutierez. Investigation revealed unscanned items worth PHP 1,935.13. Joy and Lourdes were charged with Qualified Theft before the Regional Trial Court (RTC). The RTC convicted Joy of Qualified Theft, appreciating the qualifying circumstance of grave abuse of confidence due to her position as a cashier, and convicted Lourdes of simple theft. The Court of Appeals affirmed Joy’s conviction for Qualified Theft. Joy elevated the case to the Supreme Court, arguing that her failure to scan could be human error and that mere relationship with her co-accused is insufficient proof of conspiracy.
ISSUE
Whether the prosecution proved beyond reasonable doubt all the elements of Qualified Theft, particularly the element of grave abuse of confidence.
RULING
The Supreme Court found the petition partly meritorious. It held that the prosecution failed to establish the element of grave abuse of confidence necessary for Qualified Theft. The Court ruled that the job description of a grocery cashier does not automatically entail the high degree of confidence or special trust required to qualify the crime. The evidence did not show that Joy’s duties involved custody, guardianship, or exclusive access to the employer’s property beyond the ordinary tasks of a cashier. Therefore, Joy was guilty only of simple theft. The Court modified the appealed decision, finding Joy guilty of simple theft and sentencing her to six (6) months of imprisonment. The civil liability was deleted as the stolen items were returned.
