G.R. No. 2057, April 29, 1905
THE UNITED STATES, plaintiff-appellee, vs. ADRIANO CONCEPCION, defendant-appellant.
FACTS:
Adriano Concepcion was convicted of the crime of brigandage by the Court of First Instance of Surigao and sentenced to death, with payment of one-half of the trial costs. The conviction was based on evidence showing that he organized a band of dangerous and desperate brigands, was accepted and recognized as its chief, and took direct part in the killing of Constabulary officer Lewis Clark. This killing occurred on March 23, 1903, when the band attacked and robbed the Constabulary quarters in the town of Surigao.
ISSUE:
Whether the conviction of Adriano Concepcion for the crime of brigandage should be affirmed.
RULING:
Yes, the conviction is affirmed. The Supreme Court found no error in the proceedings prejudicial to the rights of the accused. The evidence adduced at the trial sustained the findings of the trial court and established the guilt of the appellant beyond a reasonable doubt. The sentence of the trial court was affirmed, with the costs of the appeal assessed against the appellant.
