FACTS
The case stemmed from an altercation on June 24, 2001, in Bulan, Sorsogon. The prosecution’s evidence established that after a near-collision between two tricycles, a heated argument ensued between the victim, Rosalino Gernale, and the accused, Ramon Placer and his brother Virgilio. After initially parting ways, the Placers chased and blocked Gernale’s tricycle. A second confrontation occurred, during which Ramon stabbed Gernale in the chest. As Gernale fell, Virgilio stabbed him in the stomach, resulting in Gernale’s death from multiple stab wounds. Ramon later surrendered to authorities.
The defense presented a different account, claiming Ramon acted in self-defense. Ramon testified that he intervened upon hearing his brother was in an altercation. He asserted that Gernale attacked him with a Batangas knife, and he merely wrested the weapon and used it against Gernale in the ensuing struggle.
ISSUE
Whether the qualifying circumstance of treachery was proven to elevate the killing from Homicide to Murder.
RULING
The Supreme Court modified the conviction from Murder to Homicide. The Court affirmed the factual findings of the lower courts that Ramon Placer inflicted the fatal wounds, rejecting his claim of self-defense due to the lack of unlawful aggression on the victim’s part. However, the Court meticulously examined the evidence for the qualifying circumstance of treachery. For treachery to qualify a killing as murder, the prosecution must prove that the means of execution were deliberately and consciously adopted to ensure the attack without risk to the assailant from any defense the victim might make.
The Court found that the prosecution failed to establish this deliberate manner of attack. The incident arose from a series of heated arguments and two separate face-to-face confrontations between the parties. The evidence did not show that Ramon employed a method of attack specifically intended to surprise Gernale or render him defenseless. The killing occurred during a sudden, violent quarrel where the victim was aware of the impending danger and was even being pacified by his sister. Thus, the element of treachery was not proven beyond reasonable doubt. Absent any qualifying circumstance, the crime committed is Homicide under Article 249 of the Revised Penal Code. The Court sentenced Ramon Placer to an indeterminate penalty of eight years and one day of prision mayor as minimum to fourteen years, eight months, and one day of reclusion temporal as maximum.
