THE UNITED STATES, complainant-appellee, vs. DOMINGO LASCANO, defendant-appellant.
FACTS:
Domingo Lascano was convicted of the crime of brigandage and sentenced to death by the Court of First Instance of Batangas. The case was elevated to the Supreme Court en consulta. The evidence conclusively established his guilt, proving that for many months prior to his arrest in August 1903, he had served as a petty chief of a band of brigands operating along the borders of Batangas and Tayabas. It was further proven beyond a reasonable doubt that on February 8, 1903, the accused, along with other members of his band, captured five travelers on the road from Magallanes, Cavite, to Nasugbu, Batangas. After robbing them, they tied one of the travelers, Severo Rol, to a tree and deliberately stabbed him to death while he was helpless and defenseless, with the accused striking the fatal blow.
ISSUE:
Whether the conviction of Domingo Lascano for the crime of brigandage and the imposition of the death penalty are in accordance with law and supported by the evidence.
RULING:
The Supreme Court affirmed the judgment of the trial court. The Court found no error in the proceedings prejudicial to the rights of the accused. It held that the sentence of the trial court was fully supported by the law and the evidence. The death penalty was therefore confirmed.
