THE UNITED STATES, complainant-appellee, vs. FIDELES RANA, ET AL., defendants-appellants.
FACTS:
The defendants, Fideles Rana and Felipe Valdeabella, were charged with the crime of robbery with homicide. The Court of First Instance of La Laguna found that on October 22, 1903, Mateo Macahasa received 144 pesos from a Chinaman in Santa Cruz. Macahasa then boarded Valdeabella’s banca to return to Lumbang, followed by Rana in another banca. Upon reaching Maitalang, Rana attacked and killed Macahasa with a bolo, took his money, and later gave a portion of it to Valdeabella. The trial court convicted Rana of robbery with homicide, aggravated by treachery (alevosia), and sentenced him to death. It convicted Valdeabella as an accessory after the fact and sentenced him to eight years and one day of presidio mayor. Both appealed.
ISSUE:
Whether the aggravating circumstance of treachery (alevosia) was sufficiently proven to justify the imposition of the death penalty upon Fideles Rana.
RULING:
No. The Supreme Court modified the trial court’s decision. It held that the evidence on record was insufficient to prove the aggravating circumstance of treachery. The lone eyewitness, Felipe Valdeabella, did not provide clear details on how the assault was initiated, specifically whether the attack was made from behind or in a manner that prevented any defense. The location of the wounds (one on the posterior cranium, another at the base of the skull, and one on the face) did not conclusively establish treachery, as it was not proven which wound was inflicted first. The Court ruled that an aggravating circumstance must be proven with the same certainty as the crime itself. In the absence of any aggravating or mitigating circumstance, the prescribed penalty for robbery with homicide under the Penal Code is cadena perpetua. The Court affirmed Valdeabella’s conviction as an accessory. The dispositive portion sentenced Fideles Rana to cadena perpetua and affirmed the rest of the trial court’s judgment against both appellants.
