FACTS
Accused-appellants Major Emilio Comiling and Geraldo Galingan, along with others, were charged with Robbery with Homicide. The prosecution alleged that on September 2, 1995, armed men robbed the Masterline Grocery in Tayug, Pangasinan, taking cash and jewelry. During their escape, a responding policeman, PO3 Erwil Pastor, was shot and killed. A key witness, Naty Panimbaan, testified to attending several planning meetings where Comiling and Galingan were present and provided instructions and firearms for the robbery. The trial court convicted Comiling and Galingan and imposed the death penalty, prompting this automatic review.
ISSUE
The core issue is whether the guilt of appellants Comiling and Galingan for the crime of Robbery with Homicide was proven beyond reasonable doubt.
RULING
The Supreme Court affirmed the conviction but modified the penalty to reclusion perpetua, as the requisite qualifying circumstances for the death penalty were not proven. The Court upheld the trial court’s findings, giving weight to the testimony of witness Naty Panimbaan. Her detailed account of the planning meetings, where appellants were active participants, established conspiracy. The Court ruled that her testimony was credible and consistent, and her initial reluctance to come forward was satisfactorily explained. Conspiracy having been established, all conspirators are liable for the acts committed in furtherance of the common criminal design, including the killing that occurred during the robbery. The Court also modified the awarded damages, ordering appellants to pay, in solidum, actual damages for the stolen items, civil indemnity, and temperate damages to the victim’s heirs.
