G.R. No. 139971; January 17, 2002
PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. RAMON TROPA y TORREFIEL, RICKY alias “ABEL” TROPA y TORREFIEL, and MARLON TROPA y TORREFIEL, accused. RAMON TROPA y TORREFIEL, RICKY alias “ABEL” TROPA y TORREFIEL, accused-appellants.
FACTS
On October 10, 1998, the remains of Loriana Tropa, grandmother of the accused-appellants and mother of the victim Doroteo Tropa, were buried. The victim did not attend his own mother’s burial. That same evening, accused-appellants Ramon and Ricky Tropa, along with their cousin Jayrose (the victim’s son), were drinking at Ramon’s house. Ramon retrieved a bolo, made threatening remarks about another relative, and proceeded to the victim’s nearby house. Doroteo confronted Ramon about the commotion, prompting Ramon to punch him and hack him with the bolo. As the victim fled, Ricky pursued and hacked him on the leg. The brothers then inflicted multiple fatal hackings on Doroteo, causing his death.
ISSUE
Whether the guilt of accused-appellants for the crime of murder was proven beyond reasonable doubt.
RULING
Yes, the Supreme Court affirmed the conviction for murder. The Court upheld the trial court’s reliance on the clear, categorical, and consistent testimonies of eyewitnesses, particularly Jayrose Tropa, which positively identified accused-appellants as the perpetrators. The defense of denial and alibi could not prevail over this positive identification. While the precise motive for the killing was not fully established, the evidence sufficiently showed that the attack was attended by treachery. The victim was unarmed and was suddenly and unexpectedly attacked by the accused who were armed with bolos, leaving him with no opportunity to defend himself. This qualifying circumstance elevated the crime from homicide to murder. The Court modified the damages awarded, ordering accused-appellants to jointly pay civil indemnity and an additional sum as moral damages to the victim’s heirs.
