FACTS
On March 24, 1986, armed men robbed the house of the Alcantara family in Kidapawan, Cotabato, taking cash and valuables. During the robbery, the 13-year-old daughter, Marites Alcantara, was allegedly raped by several perpetrators, including appellants Joel Janson and Ricky Pinantao. The prosecution’s case hinged on the testimonies of the victim and her family members, who claimed they recognized the appellants despite the assailants being masked, citing factors like their physical builds, Pinantao’s amputated hand, their voices, and moonlight illumination. The appellants denied the charges and presented alibis.
The Regional Trial Court convicted appellants of robbery with rape and sentenced them to reclusion perpetua. On appeal, the Supreme Court scrutinized the sufficiency of the prosecution’s evidence, particularly the identification of the accused.
ISSUE
Whether the prosecution proved the guilt of the appellants beyond reasonable doubt.
RULING
The Supreme Court REVERSED the conviction and ACQUITTED the appellants. The Court held that the prosecution failed to meet the required standard of proof beyond reasonable doubt. The identification of the appellants was deemed unreliable and insufficient. The witnesses claimed recognition despite masks, poor lighting, and stressful conditions, rendering their testimonies inconsistent and doubtful. The Court emphasized that in criminal cases, the evidence must establish moral certainty of the accused’s guilt. Here, the identification was not credible, as it was improbable for witnesses to recognize masked individuals under such circumstances. The defense of alibi, while generally weak, gains significance when the prosecution’s evidence is itself frail. The constitutional presumption of innocence prevails when the evidence for the prosecution does not overcome reasonable doubt. Consequently, the appellants were ordered released.
