FACTS
Accused-appellant Ruben Montilla was arrested without a warrant while alighting from a passenger jeepney carrying a traveling bag and a carton. The arrest was based on an intelligence report received by police the previous day. A search incidental to the arrest allegedly yielded illegal items. The trial court imposed the death penalty. The case is on appeal, with a separate opinion by Justice Panganiban focusing on the validity of the warrantless arrest and search.
ISSUE
The primary issue in the separate opinion is whether the warrantless arrest of appellant and the subsequent search were valid under the exceptions to the warrant requirement, particularly as a search incidental to a lawful arrest under Section 5(a), Rule 113 of the Rules of Court.
RULING
Justice Panganiban, in his separate opinion, ruled that the warrantless arrest and search were illegal. The arrest did not fall under the in flagrante delicto rule because the arresting officers had no personal knowledge that Montilla was committing, had just committed, or was attempting to commit an offense at the moment of his arrest. He was merely alighting from a jeepney with baggage, with no overt act indicating a crime. The “hot pursuit” doctrine was also inapplicable as there was no undisputed fact that a crime had actually been committed prior to the arrest. The raw intelligence information alone was insufficient to justify a warrantless arrest, and there was sufficient time for the police to have secured a warrant. However, the opinion concludes that appellant effectively waived his right to object to the illegality of his arrest and search by pleading not guilty and participating in the trial. Thus, while the arrest and search were illegal, the waiver permits the affirmation of his conviction, but with the modification of the penalty to reclusion perpetua due to the absence of aggravating circumstances.
