THE UNITED STATES, complainant-appellee, vs. PLACIDO ESPIRIDION, ET AL., defendants-appellants.
FACTS:
The defendants were charged with the crime of bandolerismo and were tried in the Court of First Instance of the Province of Rizal. After trial, two of the defendants, Placido Espiridion and Tiburcio de la Cruz, were acquitted and discharged. The remaining three defendants were convicted of bandolerismo under Section 4 of Act No. 518 of the Philippine Commission and were each sentenced to ten years of imprisonment.
ISSUE:
Whether the evidence presented by the prosecution was sufficient to prove the guilt of the accused for the crime of bandolerismo.
RULING:
No. The Supreme Court found that the evidence was not sufficiently certain to establish the guilt of the accused. The proof failed to demonstrate that the accused had conspired to commit robbery, had actually committed robbery, or had provided any form of aid or comfort to bandits or brigands. Consequently, the sentence of the lower court was reversed, and all defendants were ordered discharged.
