FACTS
These consolidated administrative cases stem from an entrapment operation conducted by the NBI. Complainant Ma. Victoria Hidalgo, an insurance agent, alleged that respondent Moreno Magtibay, a process server, and a jail officer were demanding ₱2,000 as “grease money” to facilitate the release of a detainee with a pending case. The NBI orchestrated an entrapment on October 16, 2001, providing Hidalgo with marked money. At the Hall of Justice, Magtibay instructed Hidalgo to give the money to his co-accused, Bienvenido Precilla. Upon Hidalgo handing over the cash and giving the pre-arranged signal, NBI agents arrested Precilla and subsequently accosted Magtibay as he was leaving. Both were criminally charged. Separately, Executive Judge Voltaire Rosales filed an administrative complaint against Magtibay and Clerk III Niño Metrillo for gross misconduct, based on the same incident and for submitting falsified daily time records.
