FACTS
Respondent Jose M. Silva filed a motion to dismiss the petition for certiorari on September 25, 1964. The ground for dismissal was that the provisional permit dated March 5, 1964, whose validity was the subject of the petition, had been cancelled, rendering the petition moot. Petitioners, required to answer the motion, filed a statement on October 26, 1964, stating they interposed no objection to the immediate dismissal, but only of nine specific enumerated Public Service Commission cases.
ISSUE
Whether the petition for certiorari should be dismissed as moot and academic due to the cancellation of the provisional permit which was its subject matter.
RULING
The Court granted the motion to dismiss, but only in relation to the nine specific Public Service Commission cases enumerated by the petitioners in their statement. These cases were: PSC Case Nos. 62-4264 (Arturo Miranda), 62-4704 (Ambrosio R. Ona), 62-6073 (Iluminada Gonzales), 63-6002 (Milagros Macasaet), 63-2733 (Jose M. Silva), 63-5224 (Jose M. Silva), 63-6010 (Romeo Silva), 62-7102 (Servillano Manguiat), and 63-6017 (Benedicto Katigbak).
