CHAPCHAP, plaintiff-appellee, vs. TOMAS CACAYAN, defendant-appellant.

FACTS:
The case involves a dispute over a parcel of land. The defendant-appellant, Tomas Cacayan, relies on a notarial document of purchase and sale (Exhibit 1) executed in 1896 and registered in 1903, by which he purchased the land from Cayat, the deceased husband of the plaintiff-appellee, Chapchap, for P300. The plaintiff admits a transaction occurred but alleges it was not a sale but a pledge or mortgage to secure a loan of P100. She presented witnesses who testified that Cacayan himself described the transaction as a loan at the time. The plaintiff also points to an inconsistency: the notarial document states Cayat could not sign, but evidence was presented that he could. She further testified that she offered to repay the P100 loan to Cacayan in the presence of the provincial governor, but Cacayan asked for time to consider.

ISSUE:
Whether the notarial document (Exhibit 1) purporting to be a deed of absolute sale is authentic and valid, or whether it was fraudulently executed to conceal a loan transaction.

RULING:
The Supreme Court REVERSED the judgment of the lower court and ABSOLVED the defendant from the complaint. The notarial document (Exhibit 1) is upheld as authentic and valid.

The Court ruled that a notarial document executed under the Spanish Notarial Law carries a strong presumption of regularity and accuracy. The notary was obligated by law to verify the identities of the parties. The mere fact that the document incorrectly stated the vendor could not sign (when evidence showed he could) is insufficient to prove fraud in its execution. The testimony regarding the alleged tender of P100 repayment was deemed vague and unsatisfactory. The plaintiff’s affirmative allegation of fraud was not proven by clear and convincing evidence. Therefore, the document of purchase and sale must be given full faith and credit, providing no basis for the plaintiff’s action to recover the land.
