FACTS:
The Government of the Philippine Islands (plaintiff-appellee) filed an action in the Court of First Instance (CFI) of Manila, seeking a judgment for P141.24, plus interest and costs. The CFI rendered judgment in favor of the plaintiff for the said sum. The defendants (appellants) appealed this judgment. No question regarding the CFI’s jurisdiction was raised by either party in the CFI or in their briefs before the Supreme Court; however, the Supreme Court noticed the want of jurisdiction upon reviewing the record.
ISSUE:
Whether the Court of First Instance had jurisdiction over an action where the demand, exclusive of interest, amounted to P141.24.
RULING:
Yes, the Court of First Instance (CFI) did not have jurisdiction over the case.
The Supreme Court held that, pursuant to Section 56(3) of Act No. 136 , Courts of First Instance have original jurisdiction only in cases where the demand, exclusive of interest, or the value of the money in controversy, amounts to “one hundred dollars or more.” The Court clarified that the word “dollars” here means money of the United States, and by the terms of this section, the CFI had no jurisdiction over cases involving less than P200 (since 100 US dollars was equivalent to P200 at the time).
Since the action sought only P141.24, which falls below the jurisdictional threshold of P200, the CFI was without jurisdiction. The Court emphasized that the lack of jurisdiction over the subject matter, being apparent on the face of the record, must be taken notice of, even if not raised by the parties. Section 5 of Act No. 136 , pertaining to venue for actions against surety companies, does not alter these jurisdictional requirements.
Therefore, the Supreme Court reversed the CFI’s judgment and remanded the case with directions to dismiss the action for want of jurisdiction, without costs.
