FACTS
The Commission on Elections (COMELEC) issued Resolution No. 10147, which extended the deadline for filing the statements of contributions and expenditures (SOCEs) for the May 9, 2016 National and Local Elections. The petitioner, Partido Demokratiko Pilipino-Lakas ng Bayan (PDP-Laban), challenged this resolution. The COMELEC had previously extended the SOCE filing deadlines for the 2010 and 2013 elections. The ponencia (main decision) declared COMELEC Resolution No. 10147 void for being repugnant to Republic Act No. 7166 but applied the doctrine of operative fact to deem as timely filed the SOCEs submitted during the extended period.
ISSUE
1. Whether the mandatory character of the period for filing SOCEs under Section 14 of R.A. 7166 precludes tardy winning candidates from assuming their offices after such filing.
2. The import and coverage of the penal provisions under Section 14 of R.A. 7166.
RULING
1. No. The mandatory 30-day period for filing SOCEs under Section 14 of R.A. 7166 does not bar winning candidates who file beyond this period from assuming office. The filing of the SOCE is a condition precedent to the assumption of an elective office, regardless of whether it is filed within or beyond the 30-day period. A belated filing constitutes an administrative offense subject to fines under paragraph 4 of Section 14, but it does not result in a forfeiture of the elected seat. The COMELEC’s interpretation that winning candidates would be barred from office if they filed late was erroneous and demonstrated a need to clarify the law’s real import.

The penal provisions under Section 14 of R.A. 7166 establish that failure to file the required SOCEs constitutes an administrative offense, punishable by an administrative fine ranging from One thousand pesos (P1,000.00) to Thirty thousand pesos (P30,000.00), in the discretion of the COMELEC. For a second or subsequent offense, the fine increases, and the offender shall be subject to perpetual disqualification to hold public office. The fines are enforceable by a writ of execution if not paid within thirty days from receipt of notice. The provision applies to all candidates and political parties, except candidates for elective barangay office. The mandatory nature of the 30-day period is intended to regulate election expenditures and promote clean elections, and its violation triggers these administrative penalties, not a prohibition from assuming office.
