Case Title: RE: REPORT ON THE JUDICIAL AUDIT CONDUCTED IN THE REGIONAL TRIAL COURT – BRANCH 56, MANDAUE CITY, CEBU.
FACTS
This administrative matter stemmed from a judicial audit conducted in March 2007 in the Regional Trial Court (RTC) of Mandaue City, Branch 56, Cebu, in anticipation of the compulsory retirement of its presiding judge, Judge Augustine A. Vestil. The audit report disclosed that the court had a total caseload of 1,431 cases. It found: (1) 15 cases submitted for decision beyond the reglementary period; (2) two cases with pending incidents awaiting resolution beyond the reglementary period; and (3) 247 cases that had remained dormant for a considerable length of time. Furthermore, the court had no organized records management system; court records were in disarray, with terminated/archived cases mixed with active ones, and documents were not chronologically filed.
The Office of the Court Administrator (OCA) directed Judge Vestil to explain the delays, decide/resolve the overdue cases/incidents, and act on the dormant cases. He was also directed to adopt a proper records management system. Judge Vestil reported actions taken on the specified cases but offered no explanation for the initial delays. He acted on the 247 dormant cases before his retirement on August 8, 2007, but again provided no explanation for the prior inaction. The audit team maintained that, except for a few inadvertently listed cases, the others suffered undue delay. The OCA, in its report, found Judge Vestil guilty of undue delay and recommended a fine of ₱20,000.00 to be deducted from the ₱100,000.00 previously withheld from his retirement benefits. Judge Vestil later manifested his need for the withheld funds due to medical expenses.
ISSUE
Whether Judge Augustine A. Vestil is administratively liable for failure to decide cases and resolve incidents within the reglementary period, and for undue delay in acting on dormant cases.
RULING
Yes, Judge Vestil is administratively liable. The Court sustained the OCA’s findings but increased the fine to ₱40,000.00. The record showed undisputed delay in the disposition of numerous cases, with at least 80 civil cases (some filed as early as 1997) and 100 criminal cases pending beyond the reglementary period as of the audit. Judge Vestil’s defense of a heavy caseload was unavailing. While heavy caseloads are recognized, they do not excuse a judge’s failure to request an extension of the reglementary period from the Court, which Judge Vestil failed to do. His inaction constituted a violation of the constitutional right to a speedy disposition of cases, the Code of Judicial Conduct (specifically Canon 3, Rule 3.05), and constituted inefficiency. Accordingly, Judge Augustine A. Vestil was adjudged administratively liable for failure to decide cases within the reglementary period and FINED in the amount of ₱40,000.00, to be deducted from the ₱100,000.00 previously retained from his retirement benefits. The balance of his retirement benefits was ordered released.
