FACTS
Complainant Erlinda Bergonia was the prevailing party in a collection case. A writ of execution was issued, and respondent Sheriff Romeo Gatcheco, Jr. levied and sold a refrigerator at public auction for ₱1,600.00 on August 29, 2003. Despite the sale, Gatcheco failed to remit the proceeds to Bergonia. The Office of the Court Administrator twice required Gatcheco to comment on the complaint, which he received but ignored. The case was referred for investigation, where it was established that Gatcheco had not submitted any return or report on the writ’s execution as mandated by the rules. The notice of sale was not in the case records, and no report on the auction’s outcome was ever filed. Gatcheco was also absent from the investigation hearings despite due notice.

RULING
Yes, the respondent is guilty of dishonesty and gross misconduct warranting dismissal. The Court emphasized that sheriffs play a critical role in the execution of judgments, which is the life of the law. Gatcheco’s failure to submit the required returns and periodic reports on the writ of execution constituted a clear violation of Section 14, Rule 39 of the Rules of Court and the 2002 Revised Manual for Clerks of Court. More egregiously, his failure to remit the ₱1,600.00 auction proceeds to the judgment creditor constituted misappropriation and dishonesty. His disregard of the OCA’s directives to comment and his absence from the investigation hearings further demonstrated his guilt and contempt for the judicial process. Such actions erode public trust in the judiciary. Under Civil Service rules, dishonesty is a grave offense punishable by dismissal. Accordingly, Romeo S. Gatcheco, Jr. is DISMISSED from service with forfeiture of all retirement benefits (except accrued leave credits) and with prejudice to reemployment in any government agency.
