JUDGE BENSAUDI A. ARABANI, JR., Petitioner, vs. RAHIM A. ARABANI, et al., Respondents; and consolidated cases.
FACTS
These consolidated administrative cases involve Judge Bensaudi A. Arabani, Jr. and his staff at the 4th Shari’a Circuit Court in Maimbung, Sulu. In the first case, Judge Arabani charged his subordinates, Rahim Arabani and Abduraji Bakil, with conduct unbecoming, dishonesty, and insubordination for incidents of improper bundy card punching. The employees admitted to two instances, attributing them to mistake and haste, and offered apologies. In the second case, Judge Arabani charged his Clerk of Court, Rodrigo Ramos, Jr., with similar offenses, alleging absenteeism, refusal to properly file his bundy cards, and loafing. Ramos countered that he feared for his safety due to the judge’s intimidating bodyguards, leading him to stay near security personnel.
In the third and reciprocal case, the court staff, joined by a utility clerk from another court, filed complaints against Judge Arabani. The charges included conduct unbecoming, absenteeism, and, most seriously, sexual harassment. Specifically, it was alleged that Judge Arabani made unwelcome advances and created a hostile work environment for a female employee, Sheldalyn Maharan, including making an explicit drawing and inappropriately touching her under the guise of teaching karate.
ISSUE
The primary issue is whether the parties involved are administratively liable for the various charges of misconduct, insubordination, and sexual harassment leveled against each other.
RULING
The Court found all parties administratively liable, emphasizing that the judiciary demands the highest standards of conduct from all its personnel. Regarding the staff’s bundy card violations, the Court ruled that such acts constitute dishonesty and falsification of official documents, which are grave offenses undermining the integrity of the court. For Clerk of Court Ramos, his unexplained absences and failure to properly submit his daily time records constituted frequent unauthorized absences and loafing, also grave offenses.
Concerning Judge Arabani, the Court gave credence to the sexual harassment complaint. The allegations, particularly the creation of an explicit drawing and the unwelcome physical contact, were substantiated and constituted a severe violation of administrative rules on sexual harassment. These acts created an intimidating, hostile, and offensive work environment. The Court stressed that a judge’s behavior must be beyond reproach, and such misconduct erodes public confidence in the judiciary. Consequently, the Court imposed varying penalties: suspension for the court employees and a heavier penalty for Judge Arabani, considering the gravity of sexual harassment and his failure to uphold the dignity of his office. The decision underscores that mutual hostility does not excuse any party from their fundamental duties of honesty, decorum, and respect in the workplace.
