FACTS
The accused-appellant, Leopoldo Vinas, was convicted by the Regional Trial Court of eleven counts of rape committed against his own daughter, Luzviminda Vinas, from March 1987 to January 1988. The prosecution established a pattern of abuse where the accused, leveraging his paternal authority and using force and intimidation, would sexually assault the complainant when her mother was away working. The modus operandi involved ordering the victim to perform chores in isolated areas of their home. The victimโs testimony was corroborated by her mother and a medical certificate showing healed hymenal lacerations. The family only reported the crimes after a severe beating on February 15, 1988, which forced them to flee their home. The delay in reporting was justified by the accusedโs continuous threats and violent control over the family, which instilled a well-grounded fear for their safety. The Court rejected the defenseโs theory of fabrication, reasoning that no daughter would willingly subject herself to the humiliation of a public trial and medical examination unless motivated by a genuine desire for justice. The medical findings, though indicating healed lacerations, were consistent with the timeline of the assaults. The Court also upheld the filing of eleven separate informations, noting that each rape constituted a distinct crime. The gravity of the offense was magnified by the accusedโs violation of the sacred father-daughter relationship, making his actions particularly reprehensible. Consequently, the penalties of reclusion perpetua for each count and the awarded damages were sustained.
